1. GENERAL TERMS

1.2. Welcome to MaritimeLinkJobs.com (the "Site"). If you use this Site, including for the purposes of accessing the information made available through this website (the "Service") you will be agreeing to abide by all of the terms and conditions set out in these terms of use. In these terms of use, NSP Maritime Link Inc., its affiliates, successors and assigns is referred to as "we" or "us".

1.3. We may change, add or remove portions of these terms of use at any time, but if we do so, we will post such changes on the Site. YOUR CONTINUED USE OF THE SERVICE NOW OR FOLLOWING THE POSTING OF NOTICE OF ANY CHANGES IN THESE TERMS OF USE WILL BE DEEMED TO BE CONFIRMATION THAT YOU HAVE ACCEPTED THE RULES, CHANGES, OR MODIFICATIONS.

1.4. We may change, suspend or discontinue any aspect of the Service at any time, including the availability of any Service feature, database, or content. We may also impose limits on certain features and services or restrict your access to parts or all of the Service without notice or liability.

2. USE OF THE SITE

2.2. The Site may only be used for lawful purposes by employers, professional recruiters and human resources professionals (collectively, the "Employers") seeking to recruit employees or independent contractors, and by prospective employees or independent contractors (collectively, the "Prospective Employees") seeking job and career information and applying for jobs, all of which relate to the Maritime Link Project (collectively, the "Authorized Uses"). All Employers, Prospective Employees and any other individuals, corporations or partnerships that visit the Site or use the Services are referred to as "you" or "Users" herein. Subject to the Terms and Conditions, we grant you a non-exclusive, non-transferable, limited right to access, use and view the Site and the Services solely for the Authorized Uses.

3. Prohibited Uses of the Site

3.2. Any use of the Site which is outside the scope of the Authorized Uses is strictly prohibited. Without limiting the generality of the foregoing, the following activities constitute prohibited uses which violate the Terms and Conditions:

  • (a) Violating or attempting to violate the security of the Site including, without limitation (i) accessing personal or other information not intended for you or logging into an account which you have no prior authorization from the Site to access; (ii) impersonating any person or entity, including, without limitation, Employers or Prospective Employees, or otherwise misrepresenting your affiliation with any person, corporation, partnership or other entity; (iii) attempting to interfere with the Services available to any User, including, without limitation, submitting a virus, spyware, malware or other harmful, disruptive or destructive file to the Site, or overloading or using any device, software or routine to interfere or attempt to interfere with the proper working of the Site; or (iv) sending spam or any other type of un-solicited email or communications, including promotions and/or advertisements for products or services;
  • (b) Creating or using a false identity on the Site, or posting false, misleading or inaccurate information including, without limitation, personal profiles, resumés, cover letters or false employment opportunity postings; and
  • (c) Using e-mail addresses that you do not own or for which you do not have the express permission of the owner of such e-mail address to use.

4. CONTENT

4.2. The materials published on the Site (the "Content") may be protected by copyright, trade mark, privacy or other types of law. You must abide by all notices, information, or restrictions contained in any Content. You may not modify, publish, transmit, participate in the transfer or sale of, reproduce (except as provided in Section 4.3 of these terms of use), create new works from, distribute, perform, display, or in any way exploit, any of the Content or the Service (including software via which the Service operates) in whole or in part.

4.3. You may not use the Site in a manner that infringes or threatens to infringe the copyright, trade-mark, trade secret or other intellectual property rights of others, or violates or threatens to violate the privacy, publicity or other personal rights of others.

4.4. You may download or copy the Content and other downloadable items displayed on the Site for Authorized Uses only. Copying or storing of any Content for other than Authorized Uses is expressly prohibited.

4.5. Most Content is furnished by third parties. We are not liable for any inaccuracies, errors or omissions in any such Content, or in the transmission or delivery of all or any part of it, or for any damages arising from your use of or reliance on the Content or the Service.

5. POSTINGS

5.2. You shall not upload to, distribute or otherwise publish on the Site any libelous, defamatory, obscene, pornographic, abusive, or otherwise illegal material. You agree not to use language that abuses or discriminates on the basis of race, religion, nationality, gender, sexual preference, age, region, disability, or any other basis prohibited by law.

5.3. You are solely responsible for the content of your postings. We do not review every posting made on the Site and are not responsible for the content of the postings; however, we reserve the right to delete, move, or edit postings that we, in our sole discretion, deem abusive, defamatory, obscene, in violation of copyright, trade mark or other laws, or otherwise unacceptable. We also reserve the right, in our sole discretion, to terminate any user's posting privileges at any time. You agree that we may edit, remove, modify, any posting you make to the Site.

6. ACCESS AND AVAILABILITY OF SERVICE AND LINKS

6.2. The Site may contain links to other related internet sites, resources, sponsors and clients of the Maritime Link Project. We are not responsible for the availability of these outside resources or the content contained on them. You should direct any concerns regarding any external link to the site administrator or webmaster of such site.

7. INDEMNIFICATION AND WARRANTIES

7.2. You hereby undertake and agree to indemnify, defend and hold harmless us and all of our officers, directors, owners, agents, information providers, affiliates, licensors and licensees (collectively, the "Indemnified Parties") from and against any and all liability and costs (including, without limitation, lawyers' fees on a solicitor and client basis) incurred by the Indemnified Parties in connection with any claim arising out of any breach, either by you or any user of your account, of these terms of use or the foregoing representations, warranties and covenants. You undertake and agree to cooperate as fully as reasonably required in the defense of any such claim. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter subject to indemnification by you.

7.3. We do not warrant the accuracy or reliability of any information displayed, uploaded, or distributed through the Service by any user, information provider or any other person or entity. You acknowledge that any reliance upon any such information shall be at your sole risk. THE SERVICE IS PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. YOU HEREBY ACKNOWLEDGE THAT USE OF THE SERVICE IS AT YOUR SOLE RISK.

7.4. WE ARE NOT AN EMPLOYMENT AGENCY OR RECRUITMENT FIRM, AND MAKE NO REPRESENTATIONS OR GUARANTEES REGARDING THE EFFECTIVENESS OR TIMELINESS OF THE SITE IN MEETING THE EMPLOYMENT OBJECTIVES OR EXPECTATIONS OF USERS. WE DO NOT GUARANTEE THAT POSTINGS BY USERS WILL RESULT IN PROSPECTIVE EMPLOYEES BEING HIRED OR POSITIONS BEING FILLED, AND PLAY NO ROLE IN AND ACCEPT NO RESPONSIBILITY FOR ANY EMPLOYMENT DECISIONS MADE BY ANY USER.

7.5. WE ASSUME NO RESPONSIBILITY FOR ANY INFORMATION POSTED BY USERS, NOR DO WE ASSUME ANY RESPONSIBILITY FOR THE ACTIVITIES, OMISSIONS OR OTHER CONDUCT OF USERS. WE DO NOT SCREEN, MONITOR OR VERIFY INFORMATION POSTED BY USERS, AND HAVE NO CONTROL OVER THE TRUTH, ACCURACY OR LEGALITY OF INFORMATION POSTED, THE ABILITY OF EMPLOYERS TO OFFER POSITIONS TO PROSPECTIVE EMPLOYEES OR THE ABILITY OF PROSPECTIVE EMPLOYEES TO FILL SUCH POSITIONS. YOU ASSUME ALL RISKS ASSOCIATED WITH AND ARISING FROM YOUR DEALINGS WITH OTHER USERS. YOU ARE SOLELY RESPONSIBLE FOR THE INFORMATION YOU POST ON THE SITE AND FOR MAKING ALL NECESSARY INQUIRIES TO VERIFY AND CONFIRM THE ACCURACY, TRUTHFULNESS AND CURRENCY OF INFORMATION THAT MAY BE AVAILABLE THROUGH THE SITE AND UPON WHICH YOU MAY RELY OR INTEND TO RELY.BY ACCESSING AND USING THE SITE, YOU ACKNOWLEDGE AND AGREE THAT YOU ARE USING THE SERVICES SOLELY AT YOUR OWN RISK.

8. REGISTRATION AND SECURITY

8.2. As part of the registration process, you will select a password and a log in (your email address). You also have to give us certain registration information, all of which must be accurate and updated. You may not (i) select or use a member log in of another person with the intent to impersonate that person; (ii) use a member log in in which another person has rights without such person's authorization; or (iii) use a member log in that we, in our sole discretion, deem offensive.

8.3. You are responsible for all usage or activity on your account, including use of the account by any third party authorized by you to use your member log in and password.

9. TERMINATION

9.2. We may, in our sole discretion, terminate or suspend your access to all or part of the Service for any reason, including, without limitation, breach or assignment of these terms of use.

10. MISCELLANEOUS

10.2. These terms of use have been made in and shall be construed and enforced in accordance with the laws of the Province of Nova Scotia without reference to conflict of laws provisions, but may be enforced by the courts of any jurisdiction.
